Kisanians Platform Policies & Terms of Use

1. Acceptance of Terms

• By accessing, registering, or using the Kisanians App or website (“Platform”), you accept and agree to abide by all terms and policies outlined on this page, including our Privacy Policy, Refund Policy, Legal Policy, and any other supplemental terms.
• If you do not agree with any part of these terms, you must immediately discontinue use of the Platform.
• Use of the Platform is available only to persons who can form legally binding contracts as per applicable law. Minors must use the Platform only under the supervision and with the consent of a parent or legal guardian. Guardians are fully responsible for the minor’s actions.
• By continuing to use the Platform after policy updates, you confirm your acceptance of the new or modified terms.
• Kisanians reserves the right to deny, restrict, suspend, or terminate access or account registration to any user at its sole discretion, with or without reason or notice.

2. Legal Policy

• Kisanians is operated by SAMRUDDHA KISANIANS ONETECH PLATFORM PRIVATE LIMITED,Gno 21/1 Morwad, Tal.karmala Morwad, Karmala, Solapur, Karmala, Maharashtra, India, 413203. All Platform services and operations are subject to Indian law.
• All content, features, and advisory tools are provided “as is” and “as available,” without any warranties, express or implied. Kisanians disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Kisanians does not act as an agent, broker, or representative for any user. Users are solely responsible for their own transactions, business decisions, or agricultural actions.
• Kisanians reserves the right to update, revise, or discontinue any feature or service at any time, including removal of user content that violates these terms or Indian law.
• The Platform does not offer legal, investment, or professional agricultural advice. Any reliance on content is at your own risk.
• Kisanians is not a party to agreements or transactions between users, including sales of goods/services, business partnerships, or farmer-to-farmer contracts.
• Any disputes, claims, or controversies will be resolved under Indian law and are subject to exclusive jurisdiction of the courts in Pune, Maharashtra.
• Kisanians may cooperate with law enforcement and regulatory authorities as required and disclose user information in response to valid legal processes.
• All intellectual property, branding, software, databases, and original content are the exclusive property of Kisanians/SAMRUDDHA KISANIANS ONETECH PLATFORM PRIVATE LIMITED.

3. Risk Policy

• Agriculture, agri-business, and marketplace transactions inherently involve risks, including but not limited to weather, pest outbreaks, market price fluctuations, fraud, device malfunction, or third-party errors.
• Kisanians provides content, AI-based tools, and references for informational purposes only and does not guarantee results, business success, or absence of loss.
• Any losses (crop, financial, reputational, data, or otherwise) incurred while using the Platform are solely the user’s responsibility.
• Kisanians is not liable for failure or delay in providing Platform services due to force majeure events such as natural disasters, wars, pandemics, network failures, or government actions.
• Marketplace features may expose you to dishonest users, scams, or misrepresentation. Always verify product/service details and counterparty credentials before transacting.
• Kisanians is not responsible for damages arising from reliance on market rates, advisory, or third-party information displayed in the app.
• Users are strongly advised to maintain backups of important data and documents.
• Never share your passwords or sensitive information with anyone, including Kisanians staff. We never ask for your passwords or OTPs via email or phone.
• If you believe your account has been compromised, immediately change your password and notify us at grievance@kisanians.com.

4. AI-Based Pests & Disease Advisory Policy

• The AI crop health advisory system analyzes user-submitted images for possible diseases or pest infestations and suggests remedies based on available data, databases, and models.
• This service is meant solely for initial guidance and is not a substitute for consultation with agricultural experts or certified agronomists.
• AI recommendations may occasionally be inaccurate due to poor image quality, rare conditions, or limitations of the model. Always cross-verify critical decisions with a professional.
• Suggested medicines or interventions should only be applied after confirming local regulatory approval and label instructions. Kisanians is not responsible for side effects, legal consequences, or damages from misuse of products.
• Users are advised to observe all safety instructions, withdrawal periods, and environmental regulations before using pesticides or medicines suggested by the app.
• All uploaded images may be used (after anonymization) to train and improve AI models or for research and educational purposes. No personal data is attached to these images in any public use.
• If you encounter persistent or unidentified issues, consult local agricultural officers or government KVKs.
• Kisanians does not promote, sell, or distribute any particular brand or product; medicine suggestions are unbiased and data-driven.

5. GPS-Based Area Calculation Policy

• Area calculation is performed using GPS-based point marking; accuracy depends on your device’s GPS hardware, environmental factors, and correct usage.
• Calculated land area values are approximate and for convenience only. They should not be used for legal disputes, property transactions, loan applications, or governmental filings.
• Kisanians is not responsible for disputes or losses arising from inaccurate area calculation, boundary errors, or misuse of calculated data.
• Users must grant location access permission to use this feature. Location data is stored securely and processed according to our Privacy Policy.
• Kisanians will never share your raw GPS data with third parties except as required by law.
• Always cross-check results with official or certified measurement tools before taking any important action.

6. Agri-Business, Marketplace & Business Content Policy

• Educational content, business guides, PDF reports, and videos are provided for reference and self-learning only. Kisanians is not responsible for the accuracy, completeness, or timeliness of this content.
• Kisanians does not guarantee business profitability, yield improvement, or funding outcomes as a result of using educational materials or guides.
• The Kisanians marketplace is a platform to connect buyers and sellers (farmers, equipment dealers, agri-service providers) only; we are not a party to any transaction or agreement.
• Users are solely responsible for verifying the quality, legality, and authenticity of goods/services listed or purchased via the Platform.
• Kisanians does not vet or background-check users, products, or services. Exercise caution and conduct due diligence before transacting or entering into agreements.
• Payments for goods/services must be conducted through mutually agreed and secure channels. Kisanians is not responsible for payment disputes, non-delivery, or misrepresentation.
• Return, refund, and dispute resolution for marketplace transactions must be handled directly between buyer and seller. Kisanians provides no guarantee, mediation, or compensation in such cases.
• Kisanians reserves the right to remove fraudulent, duplicate, or inappropriate listings without notice.
• Any equipment or agri-product sold must comply with Indian law and relevant standards (e.g., BIS for machinery).
• Business promotional offers, deals, or third-party links shown on the app are for user convenience. Kisanians does not endorse or warrant third-party products or claims.

7. Cultivation Technology Content Policy

• Content relating to crop management, cultivation techniques, or technology adoption is broad-based and not tailored to any user’s unique circumstances.
• Always consider local climatic, soil, and market factors before adopting any suggested practice.
• Kisanians is not liable for any yield reduction, crop failure, or economic loss resulting from the use or misuse of such information.
• Users are encouraged to participate in local training programs, government workshops, and field demonstrations for best results.

8. Weather and Government Schemes Policy

• Weather data displayed in the app is sourced from public or third-party meteorological providers and is updated as per their data feeds. Kisanians is not liable for errors, delays, or missing weather updates.
• Do not rely solely on app weather for critical agricultural operations (e.g., pesticide spraying, irrigation scheduling). Confirm with local sources if needed.
• Government scheme information, eligibility, application links, and deadlines are aggregated from public sources. Kisanians does not act as an agent or intermediary for any scheme or subsidy.
• Kisanians never collects application fees, documents, or personal data for government scheme applications.
• Always apply for schemes via official government portals or offices. Kisanians does not guarantee approval, processing, or success in obtaining any scheme benefit.
• If you notice outdated, incorrect, or misleading information about a scheme, please notify us immediately for correction.

9. Live Market Rates Policy

• Live or daily market rates displayed in the Platform are sourced from official mandis, traders, or public data feeds wherever possible.
• Market rates are for information only and may not reflect actual rates available to you at your local market or time of sale.
• Kisanians is not responsible for losses incurred as a result of using or acting upon market price information provided by the Platform.
• Always negotiate with buyers and verify current prices before finalizing any agricultural sale or purchase.
• Market data may be unavailable during network outages or technical issues.

10. Data Privacy Policy

• Kisanians is committed to protecting your personal data. All personal and sensitive data collected (such as phone number, images, GPS coordinates, usage data, etc.) is securely processed as per Indian law and our Privacy Policy.
• Data is stored using industry-standard encryption, and access is restricted to authorized personnel only.
• We never sell, rent, or share your personal data with third parties for marketing purposes.
• Data may be shared with law enforcement or government authorities only upon valid legal request or court order.
• You have the right to access, correct, or delete your data at any time by contacting privacy@kisanians.com or through the Platform’s account deletion feature.
• Aggregated, anonymized data may be used for statistical, research, or product improvement purposes.

11. AML (Anti-Money Laundering) & Compliance Policy

• Kisanians fully complies with all applicable Indian laws on anti-money laundering (AML), KYC (Know Your Customer), and prevention of unlawful activities.
• We may request verification documents or additional information if suspicious or high-value transactions are detected via the Platform.
• Kisanians reserves the right to suspend or terminate accounts and report to relevant authorities in cases of fraud, suspicious behavior, or regulatory violations.
• Any attempt to use the Platform for unlawful activity (including money laundering, terrorism financing, or tax evasion) will result in immediate account termination and legal action.
• Kisanians will cooperate with enforcement agencies as required by Indian law.

12. User Content, Rights & Platform Use

• Users may post content such as comments, reviews, images, questions, or business listings. All user content must be accurate, legal, and non-offensive.
• Do not post, upload, or transmit content that is illegal, defamatory, hateful, abusive, obscene, infringing, or violates privacy rights or third-party intellectual property.
• By submitting content, you grant Kisanians an irrevocable, royalty-free, worldwide license to use, display, adapt, and modify your content for the operation and improvement of the Platform.
• Kisanians is not responsible for user-generated content, but reserves the right to remove or moderate any content at its sole discretion.
• Do not impersonate others or misrepresent your identity or association with any entity.
• You are solely responsible for maintaining backup copies of your content.
• Prohibited content includes, but is not limited to: spam, promotions of illegal activity, viruses, or malware.
• Repeated violations may result in permanent account ban and reporting to authorities.

13. Account, Eligibility, Suspension, Termination & Assignment

• Only individuals or entities capable of entering a legally binding contract under Indian law may register accounts. Business accounts must be registered by authorized representatives only.
• Account registration requires accurate, complete, and up-to-date information. Kisanians may suspend or terminate accounts with false, incomplete, or misleading data.
• Account credentials are confidential; you are responsible for all activity occurring under your account. Never share your password.
• Kisanians reserves the right to suspend, block, or permanently terminate any account for breach of these terms, legal violations, fraud, or abusive behavior.
• Upon termination, you lose access to all Platform features and data. Some records may be retained for compliance or legal defense.
• Kisanians may assign, transfer, or delegate its rights and obligations under these terms to affiliates or successors without prior notice.

14. Limitation of Liability & Disclaimer

• Kisanians makes no representations or warranties regarding accuracy, completeness, timeliness, or reliability of Platform content or services. Use is at your sole risk.
• In no event will Kisanians, its directors, employees, affiliates, or partners be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of access to or use of the Platform.
• Kisanians disclaims all warranties, whether express or implied, including fitness for purpose, title, or non-infringement.
• Kisanians is not responsible for damages caused by malware, viruses, cyber-attacks, data loss, or unauthorized access.
• Third-party links, advertisements, and content are provided for user convenience only. Kisanians does not endorse or guarantee external sites or services.
• Some jurisdictions may not allow certain exclusions of liability. In such cases, liability is limited to the maximum extent permitted by applicable law.

15. Indemnity

• You agree to indemnify, defend, and hold harmless Kisanians, its officers, directors, agents, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your use of the Platform or breach of these terms.
• This includes costs and expenses related to legal proceedings, third-party claims, or enforcement actions related to your conduct, content, or transactions.
• Kisanians reserves the right to assume exclusive defense in any matter subject to indemnification, at your expense.

16. Refund & Return Policy

• Kisanians itself does not directly sell physical products or services to users. Any sales made between users on the Platform are governed by their individual agreements.
• Kisanians does not offer any warranty, guarantee, return, or refund on goods/services listed or transacted via the marketplace.
• All requests for return, exchange, or refund must be resolved directly between buyer and seller. Kisanians does not mediate or provide compensation for any dispute.
• Buyers are strongly advised to verify product condition, documentation, and seller credentials before purchase.
• If you suspect fraud or criminal conduct, report immediately to local authorities and notify us at grievance@kisanians.com.

17. Notice and Take Down

• If you believe any content posted on the Platform infringes your rights, violates Indian law, or is otherwise objectionable, please contact us with full details.
• Reports can be made by emailing grievance@kisanians.com with supporting documents or screenshots.
• Kisanians will review and, if appropriate, promptly remove or restrict access to the disputed content. False reporting may result in action against the reporter.

18. Changes to Policies & Terms

• Kisanians reserves the right to change, amend, or update any policy, term, or feature of the Platform at any time without notice.
• Major updates will be notified through the app, website, or registered email addresses wherever possible.
• Continued use of the Platform after changes constitutes acceptance of the revised terms. If you do not agree, you must stop using the Platform and request account deletion.

19. Governing Law & Jurisdiction

• These policies and terms are governed exclusively by the laws of India.
• All disputes are subject to the exclusive jurisdiction of courts inGno 21/1 Morwad, Tal.karmala Morwad, Karmala, Solapur, Karmala, Maharashtra, India, 413203.
• If any provision of these terms is found invalid or unenforceable, all other provisions remain in full force and effect.

20. Severability, Waiver, Events Beyond Control, Assignment

• If any provision of these policies is determined to be unlawful, void, or unenforceable, that provision shall be deemed severable, and shall not affect the validity and enforceability of remaining provisions.
• Any failure by Kisanians to enforce a right or provision shall not constitute a waiver of that right or provision.
• Kisanians is not responsible for failure to fulfill obligations due to events beyond its reasonable control (“force majeure”).
• Kisanians may assign, transfer, or delegate its rights and duties under these terms to any affiliate or successor without notice.

21. Account Deletion Policy

• Users may request permanent deletion of their account and data at any time via the app’s “Delete Account” feature or by emailing help@kisanians.com.
• Upon receiving a valid request, all personal data, user content, and records are deleted from active systems within 30 days, except as required for compliance, fraud prevention, or legal defense.
• Some data may be retained in backups or logs for regulatory or safety purposes for a limited period.
• Account deletion is irreversible. You cannot restore data or content after deletion.

22. Data Privacy & Contact

• We are committed to protecting your privacy in accordance with Indian data protection laws.
• Personal data collected is used only for the functioning, improvement, and security of the Platform, and never shared for marketing without consent.
